Terms & Conditions

The Sisterhood Studio’ is Erin Penglis trading as The Sisterhood Studio.

‘The Client’ is the party making a booking for design related services from The Sisterhood Studio.

‘An Order’ is the request for services from The Sisterhood Studio.

‘The project’ is a term used to describe service from The Sisterhood Studio.

The terms and conditions apply to all dealings between The Client and The Sisterhood Studio. By placing an order with The Sisterhood Studio, you as a Client are forming a legally binding contract for services and you agree to the following terms & conditions.

Project Scope

The services we provide will be limited to projects discussed via email prior to the commencement of the project. If you request that we provide you with services outside of this we’ll do our best to accommodate. Additional fees will apply. 

Payments

A 50% non-refundable booking deposit is required before starting the project. Payments are to be made either by bank deposit transfer or via Stripe. There is a fee for using Stripe that the client will pay. All invoice terms are 7 business days from the date of the invoice.

Accounts which are not paid on time will incur a late administration fee of 10% which accrues monthly on the outstanding amount. Final artwork files will not be handed over until the invoice has been paid in full. All work not completed within a 2 month period will be invoiced regardless.

Payment is required for any artwork or drafts, that have been terminated at The Client’s request at any stage of development, prior to completion. Invoice will be issued as ‘work to date’.

If debt collection is required for unpaid invoices, The Client is responsible for any costs incurred (fees/commissions payable to the debt collectors).


Schedule + Timelines

The Client must provide direction + feedback on time according to the timeline layed out in your Notion Portal. If this is supplied late, The Client will incur a delay fee. The Client may not pause or put the project on hold. 

The Sisterhood Studio will make every effort to meet deadlines. All quoted turnaround times are approximate. The Sisterhood Studio will not be held responsible or liable for any costs resulting from delayed launches. 


Approval

Approval is required for all projects, via email prior to work being released. Whilst all care is taken by The Sisterhood Studio, The Sisterhood Studio is not responsible for any spelling, grammatical, numerical errors or omissions after final approval. Even if these errors are from The Sisterhood Studio, it is the Client’s responsibility to proof read and check thoroughly their projects to identify any errors prior to approval.


Deliverables

The Client agrees upon the deliverables outlined in The Client Proposal. Additional formats, files, and sizes are negotiated separately. Font files and licences are not included.


Refund Policy

The Client may cancel this Agreement for any reason by providing a minimum of 10 days written notice to The Sisterhood Studio, The Sisterhood Studio does not supply refunds. If The Client cancels this agreement, they are not able to use any of the provided artwork. 

The Sisterhood Studio may cancel this Agreement at any time for any reason by providing written notice to The Client. In the event that The Sisterhood Studio cancels this Agreement, The Sisterhood Studio will provide any artwork completed and paid for to date.

Discarded concepts remain property of The Sisterhood Studio and may not be used. The Client may not initiate payment chargebacks or disputes through their financial institution or processor. Completed work is withheld until paid in full.  


Contractor + Client Relationship

The Sisterhood Studio is an online business therefore the majority of our communication is made via email, this helps us keep track of specific design requirements & any changes required. If The Client would like to chat with us on the phone or via skype we are happy to do so, however The Client must make an appointment for a call. The Sisterhood Studio office hours are 8am - 4pm, Mon – Fri. There will be no communication outside of these hours and The Client may not receive a reply until we are back in the office. In order for best results during the project, communication should be respectful.

The Sisterhood Studio is not responsible for consulting with contractors who are part of the project. We reserve the right to subcontractors to ensure on time completion. Client is only a client for the duration of the project. 


Competes

The Sisterhood Studio is allowed to work with clients in the same field or with similar businesses. This contract does not include a non-compete. Although we do the best to make each project unique, the copyright and licence does not apply to individual elements of the project, and may use similar layouts or elements with our projects. It is not possible for clients to own common layouts and colours.


Revisions & Changes

The Client is allowed two revision cycles. If The Client requests changes to designs that they approved prior, they will incur additional fees. A new scope will result in the adjustment of timelines. The Sisterhood Studio also reserves the right to decline work. 

Change requests need to be written and documented by The Client, discussed together, sent over for approval, new timeline, and a new proposal and contract signed.


Credits

The Sisterhood Studio maintains the right to show all work in our portfolio and publicly on social media. The Client agrees to allow The Sisterhood Studio to credit design work on all websites designed by The Sisterhood Studio. If The Client would like to remove the site credit, they will incur a fee of $150AUD.


Post-Launch Support

The Sisterhood Studio offers 1 week of post-launch support. Changes to anything previously approved is not included and will be charged accordingly. 


Copyright

The Client assumes full copyright and reproduction rights upon full payment of a completed project. The Sisterhood Studio retains personal rights to use completed projects and concept artwork for the purpose of marketing The Sisterhood Studio.

All images displayed on the The Sisterhood Studio website or social media accounts are subject to copyright, and must not be copied or used without full permission from The Sisterhood Studio and the Client. Any breach of copyright will result in legal action being taken as necessary.


No Guarantees

The Sisterhood Studio cannot guarantee the outcome of design services and the client’s comments about the outcome are expressions of opinion only.
